Terms and Conditions of Use

IMPORTANT: PLEASE READ THESE TERMS AND CONDITIONS (“TERMS”) CAREFULLY BEFORE CLICKING “I ACCEPT”, “BOOK NOW”, OR USING THE TRAVELEIR PLATFORM (WEBSITE AND MOBILE APPLICATION).

By clicking “I Agree”, “Register”, “Book”, or by accessing or using the services provided by Traveleir Connect Private Limited (“Traveleir”, “We”, “Us”, or “Our”), You (“User”, “Traveller”, or “You”) agree to be bound by these Terms. If You do not agree to these Terms, You must not access or use the Services.

  1. 1. Definitions & Interpretation

    In addition to the other definitions provided in these Terms:

    • “Traveleir” refers to the technology provider that owns and operates the digital platform (App/Website) facilitating the interface between the User and the Service Providers.
    • “Service Provider” refers to the third-party hotel, travel agency, tour operator, or airline whose services are listed on the Platform.
    • “User” refers to the individual or entity accessing the Platform to search for travel services or make a Booking.
    • “Platform” refers to the website, mobile application, and associated APIs provided by Traveleir.
    • “Booking” refers to the confirmed reservation of accommodation, tours, or transport made by the User via the Platform.
    • “Services” refers to the provision of the digital interface, search aggregation, booking facilitation, and payment processing tools provided by Traveleir.

  2. 2. Nature of Service (Disclaimer of Agency)

    • Technology Provider Only: You explicitly acknowledge that Traveleir is a technology service provider and intermediary and not a hotelier, travel agency, or transport operator. We provide the digital infrastructure to connect You with Service Providers.
    • Contractual Relationship: When You make a Booking, the contract for the provision of the service (e.g., the hotel stay or tour) is created directly between You and the Service Provider. Traveleir is not a party to that contractual relationship and acts solely as an agent for the Service Provider.
    • Information Accuracy: Data provided on the Platform (pricing, availability, amenities, ratings) is based on information provided by the Service Providers. While We verify data to the best of Our ability, Traveleir does not guarantee the accuracy of such content and shall not be liable for errors or misrepresentations by Service Providers.

  3. 3. Account Security & Digital Signature

    • Digital Signature: Pursuant to the Electronic Transactions Act, 2063, Your use of a Username, Password, OTP, or clicking “Book Now” / “Pay” constitutes Your “Digital Signature”. Any action performed (booking/cancellation/payment) using these credentials is legally binding on You.
    • Confidentiality: You agree to keep Your login credentials confidential. Traveleir shall not be liable for any loss arising from unauthorized access resulting from Your failure to secure Your device or credentials.
    • Notification: You must immediately notify Traveleir if You suspect unauthorized use of Your account.

  4. 4. Booking, Payment & Financial Obligations

    • Payment Terms:
      • Pre-Payment: For “Pay Now” bookings, You agree to pay the total booking value (inclusive of taxes) immediately via the Platform. Traveleir collects this on behalf of the Service Provider.
      • Pay at Hotel: For “Pay at Property” bookings, You agree to pay the Service Provider directly upon arrival in the local currency.
      • Currency & Taxes: Prices displayed may exclude specific local taxes (e.g., City Tax) which must be paid directly to the Service Provider. You acknowledge that currency exchange rates may fluctuate between the booking date and payment date.
    • Cancellations & Refunds:
      • Policy: Every Booking is subject to the specific Cancellation Policy of the Service Provider (Non-Refundable, Flexible, etc.) displayed at the time of booking.
      • Refund Processing: If You are entitled to a refund, Traveleir will process it to the original payment method within 7-14 business days. We are not responsible for delays caused by banking networks.
    • Fraud Prevention: You declare that all funds used for Bookings are from legitimate sources in compliance with the Asset (Money) Laundering Prevention Act, 2064. You shall not use the Platform for any unlawful financial activities.

  5. 5. Data Privacy & Consent

    • Consent to Process: By using this Platform, You explicitly consent (as per the Privacy Act, 2075) to Traveleir collecting, storing, and processing Your personal data, booking history, and device information.
    • Third-Party Sharing: You grant Traveleir permission to share Your necessary personal details (Name, Contact, Special Requests) with:
      • The Service Provider (Hotel/Agency) to fulfill the Booking.
      • Payment Gateways to facilitate transaction processing.
      • Regulatory Bodies if required by law.
    • Data Security: Traveleir employs industry-standard encryption to protect Your data. However, You acknowledge that no transmission over the internet is 100% secure.

  6. 6. Limitation of Liability & Indemnity

    • “As Is” Service: The Platform is provided on an “as is” and “as available” basis.
    • No Liability for Service Failure: Traveleir is not liable for any acts, errors, omissions, representations, warranties, breaches, or negligence of any Service Provider or for any personal injuries, death, property damage, or other damages or expenses resulting there from. We do not guarantee the quality or safety of the accommodation or tour.
    • Indemnity: You agree to indemnify and hold harmless Traveleir, its directors, employees, and affiliates from any claims, losses, or damages arising out of Your violation of these Terms, Your use of the Platform, or Your violation of any third-party rights.

  7. 7. Intellectual Property Rights

    All content, code, User interface design, logos, and software associated with the Traveleir Platform are the exclusive intellectual property of Traveleir Connect Private Limited. You are granted a limited, revocable, non-exclusive license to use the App/Website for personal travel booking use only. You may not reverse-engineer, copy, scrape, or distribute the software or content.

  8. 8. User Conduct & Prohibited Activities

    You agree not to:

    • Make any speculative, false, or fraudulent bookings.
    • Use any automated means (robots, spiders) to access the Platform.
    • Post reviews that are fake, malicious, or contain profanity.
    • Violate any local laws regarding travel or conduct at the Service Provider's premises.

  9. 9. Force Majeure

    Traveleir shall not be liable for any failure to perform its obligations (including booking confirmation or refund processing) where such failure results from any cause beyond Traveleir’s reasonable control, including but not limited to Acts of God, war, riots, government decrees, pandemics, airline strikes, or mechanical/electronic failures (internet/server outages).

  10. 10. Governing Law & Dispute Resolution

    • Jurisdiction: These Terms are governed by the laws of Nepal.
    • Dispute Resolution: Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the District Court of Kathmandu.
